Dear Doctor:
Attached, you will find the myriad of denials we have received from UCCI,
and explanations given as to why we feel your examiners were unjustified
in said denials. You will note that on several of them, our X-rays
and photographs, which were our documentation to you of the necessity
for treatment, were never returned to us. I would hope that you
can find them, as they are the only copies we have (and we will not part
with our originals-they are our defense, in the eventuality we find it
necessary to bring suit against UCCI for unfair business practices). As I have stated before, without your examiner's presence in our operatories,
it would be impossible to see what we see. I would also question
the fact that in very many cases (see attached listing of "cases where
the money went to the patient") our money was sent to the patient.
These obstacles that you keep throwing in our earnest and honest pursuit
of fair compensation for the excellent treatment we have given your insured
has made it untenable for us to maintain our relationship with United
Concordia.
In the interim, any payments for approved or routine services should
come directly to us. Additionally, we would request that you rectify
the error of the checks having been sent to patients by writing us a check,
and then collecting the amount you paid in error to the patients.
A copy of this letter has been sent to the State Commission of Insurance
in both NJ and PA. My attorney has been kept abreast of this situation,
and we are weighing many different remedies. We await your reply
before any further action will be taken. Sincerely,
